Terms of Service
Welcome to NXT Point. These Terms of Service ("Terms") govern your access to and use of this website and online store (the "Site"), operated by NXT Point ("NXT Point," "we," "us," or "our"). By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.
1. Use of the Site
You agree to use the Site only for lawful purposes and in accordance with these Terms. You agree to:
- Provide accurate, current, and complete information in forms, accounts, and orders.
- Not use the Site to send unsolicited messages (spam), defamatory or unlawful material, or malware.
- Not attempt unauthorized access to the Site, its systems, or any networks connected to it.
You must be at least 18 years old, or have the consent of a parent or legal guardian, to make a purchase.
2. Products, Orders, and Payment
Product information. We make every effort to display our products, including colors, images, and specifications, as accurately as possible. Actual colors may vary depending on your screen, and we do not guarantee that product descriptions or other content on the Site are error-free.
Orders. Placing an order is an offer to purchase. An order is confirmed only when you receive an order confirmation email from us. We reserve the right to refuse, limit, or cancel any order at any time, including in cases of pricing or inventory errors, suspected fraud, or unavailability of a product. If we cancel an order after payment, we will issue a full refund.
Prices and taxes. All prices are in U.S. dollars and are subject to change without notice. Applicable sales taxes are calculated at checkout. Shipping costs are shown at checkout and are described in our Shipping Policy.
Payment. Payments are processed securely through Shopify and its payment providers. By submitting an order, you confirm that you are authorized to use the payment method provided. We do not store your full payment card details.
Promotions. Discount codes and promotions are subject to their stated terms, cannot be combined unless indicated, and may be modified or withdrawn at any time.
Shipping and returns. Shipping and returns are governed by our Shipping Policy and Return Policy, which are incorporated into these Terms.
3. Training Programs and Facility Information
The Site may include information about tennis, padel, and pickleball training programs and related facilities. This information is provided for general purposes only. Submitting a contact form, requesting information, or using any tool on the Site does not constitute a reservation, an enrollment, or a service agreement. Enrollment in any program, class, or activity is completed separately, directly with NXT Point, and may require signing a liability waiver and enrollment documents before participation.
Program schedules, coaches, prices, promotions, and court availability are subject to change without notice. NXT Point may modify or discontinue any program at any time.
4. Sports Equipment and Assumption of Risk
Racquet sports involve a risk of injury. Our products must be used only for their intended purpose and in accordance with the manufacturer's instructions. You are responsible for choosing equipment suitable for your level and physical condition. To the fullest extent permitted by law, you assume all risks associated with the use of the products purchased through the Site.
5. Warranties and Disclaimers
Products sold on the Site may be covered by the manufacturer's warranty, which varies by brand and product. Except for any such warranty and any rights that cannot be excluded by law, the Site and all products and content are provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the Site will operate uninterrupted or free of technical errors.
6. Intellectual Property
All content on this Site, including logos, trademarks ("NXT POINT" and related slogans), text, images, videos, graphic design, and source code, is the property of NXT Point or its licensors and is protected by United States and international intellectual property laws. Third-party brand names, logos, and trademarks displayed on the Site belong to their respective owners and are used for identification and sales purposes only.
Reproduction, distribution, modification, or commercial use of any material from this Site is prohibited without the prior written consent of NXT Point.
7. Accuracy of Information and Changes
We strive to keep the information on the Site current and accurate, but we do not guarantee that it is complete or error-free. Product availability, prices, and promotions may change at any time without notice.
8. Limitation of Liability
To the fullest extent permitted by applicable law in the State of Florida:
- NXT Point shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from the use of, or inability to use, the Site or the products purchased through it.
- Our total liability for any claim related to a purchase shall not exceed the amount you paid for the product that is the subject of the claim.
Nothing in these Terms limits any rights you may have under applicable consumer protection laws that cannot be waived.

The Site may contain links to third-party websites (for example, social media or booking platforms). NXT Point does not control and is not responsible for the content, privacy policies, or practices of those websites.
